Important legal information about using HttpStatus

Please read these Terms of Service carefully before using this Service.
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural. Section titles and headings are for convenience only and shall not affect the interpretation of these Terms.
For the purposes of these Terms of Service:
Account means a unique account created for You to access certain parts of the Service, such as the HttpStatus API.
Country refers to the Netherlands
Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Crafted Code. Crafted Code is a trade name of Alexander M. Heilbron, registered with the Dutch Chamber of Commerce under number 96167432.
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of the Service.
Service refers to the Website, the HttpStatus web application and the HttpStatus API. Even if certain features of the Website or web application are currently offered free of charge, they remain part of the Service.
Subscriptions refer to the services or access to the Service offered on a subscription basis by the Company to You.
Free Trial refers to a limited period of time that may be offered without charge when purchasing a Subscription.
Terms of Service (also referred as "Terms") mean these Terms of Service that form the entire agreement between You and the Company regarding the use of the Service.
Third-party Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
Website refers to httpstatus.io, accessible from https://httpstatus.io
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
These Terms of Service govern Your use of the Service and form the entire agreement between You and the Company. They set out the rights and obligations of all visitors, users, and other individuals or entities who access or use the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. By accessing or using the Service, You agree to be bound by these Terms. If You do not agree to these Terms, You must immediately stop using the Service.
You represent that You are at least 18 years old. The Company does not permit anyone under 18 to create an Account or use the Service.
Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Company's Privacy Policy, which describes how We collect, use, and disclose Your personal information and informs You of Your privacy rights. Please read the Privacy Policy carefully before using the Service.
The Service, or certain parts of the Service, are available only with a paid Subscription. Depending on the plan selected, Subscriptions may be offered on a monthly or annual recurring basis, or as a one-time purchase. Free plans may also be offered on a limited basis.
If applicable, monthly overage charges will be billed in addition to the recurring fee if You exceed the quota limits of a Subscription plan that allows overages.
At the end of each billing period, Your recurring Subscription will automatically renew under the same conditions unless cancelled by You or by the Company. You are solely responsible for managing and cancelling Your Subscription in advance of renewal if You do not wish to continue.
Upgrades and downgrades of Subscriptions may be managed through the Company’s API gateway (such as Nadles). Availability of upgrades, downgrades, or plan changes depends on the features and limitations of the gateway. In some cases, credits for unused time may be prorated and applied to Your account as a balance toward future payments. Such credits are not refundable in cash.
Annual Subscriptions may be upgraded to higher-tier plans, but cannot be downgraded or converted to monthly Subscriptions.
You may cancel Your Subscription renewal only through the Subscription dashboard provided by the Company's API gateway (such as Nadles). This will place Your Subscription in a pending cancellation state, allowing You to continue using the Service until the end of the current billing period, after which the Subscription will automatically terminate.
Cancellations attempted through other channels, including directly via the payment processor (such as Paddle), are not supported and may result in immediate termination of access without a pending cancellation period. In such cases, the Company shall not be responsible for any loss of access, usage, or billing discrepancies resulting from cancellation through unauthorized methods.
Cancellation does not entitle You to a refund of fees already paid for the current Subscription period, except where required by law or expressly permitted under these Terms.
You must provide the Company with accurate and complete billing information, including full name, address, postal code, telephone number, and valid payment method details.
Subscriptions and related payments are managed through the Company's third-party service providers, including the API gateway (such as Nadles) and payment processor (such as Paddle).
If an automatic payment attempt fails for any reason, You will be notified by email from the API gateway. It is Your responsibility to ensure that Your payment method remains valid and that sufficient funds are available.
In certain cases, the Company may attempt to retry the payment manually through its service providers; however, the Company is under no obligation to do so. If payment is not successfully completed within the specified timeframe, Your access to the Service may be suspended or terminated.
The Company may, at its sole discretion, modify the fees for Subscription plans at any time. Any such changes will apply only to new Subscriptions purchased after the effective date of the change. Existing Subscriptions will continue under the fee structure that was in effect at the time of purchase, unless otherwise agreed between You and the Company.
One-Off Plans provide a fixed number of credits for use with the Service. Credits may be used at any time and will remain available while the Service is offered, unless the Company specifies otherwise. The Company reserves the right to modify or discontinue the Service or any One-Off Plan at its sole discretion. Any remaining credits at the time of such modification or discontinuation will not be automatically refunded or replaced, but may be handled at the Company's discretion.
The Company may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time. At the time of publication, no Free Trial is currently offered.
Participation in a Free Trial may require You to provide Your billing information. You will not be charged until the Free Trial expires. At the end of the Free Trial period, You will only be charged the applicable Subscription fees if You continue with the Subscription.
The Company reserves the right, at any time and without prior notice, to (i) modify the terms of any Free Trial offer, or (ii) discontinue a Free Trial offer.
Use of the Free Plan does not require You to provide any payment method. Access to features included in the Free Plan is offered without charge, subject to these Terms of Service.
Except where required by law, all Subscription fees are non-refundable. Certain refund requests may be considered by the Company on a case-by-case basis and may be granted at the sole discretion of the Company.
If You are not satisfied with the Service, You may request a refund of Your first Subscription payment within 14 days of the initial purchase. Subsequent Subscription payments are not eligible for a refund.
Subscriptions automatically continue at the fee structure in effect at the time of purchase unless cancelled by You. Forgetting to cancel, being unaware of a renewal, or failing to use the Service does not constitute grounds for a refund. To benefit from updated pricing, if available, You must cancel Your existing Subscription and purchase a new one under the revised terms.
For one-time purchases, You may request a refund within 14 days of the purchase, provided that the product has not been accessed or used during this period.
If You upgrade or downgrade a Subscription, unused time from the current billing period may be prorated and credited to Your account balance with the API gateway (such as Nadles). Credits may be applied to future Subscription payments, including overages or pay-per-use charges. Credits are not refundable in cash.
If You believe a payment has been made in error, You must contact support@httpstatus.io before initiating any chargeback with Your bank or payment provider. In most cases, the Company can resolve billing issues quickly and, where appropriate, issue a refund directly.
Refund requests submitted via the Paddle Customer Portal or other authorized payment channels are processed according to this Refund Policy. Initiating a chargeback for a valid transaction may result in suspension or termination of Your account.
When You create an account with Us, whether directly through the Service or via a Third-Party Service integrated with the Service (such as an API gateway or payment processor), You must provide accurate, complete, and up-to-date information. Failure to do so constitutes a breach of these Terms and may result in the suspension or termination of Your account.
You are solely responsible for safeguarding Your login credentials and for all activities that occur under Your account, whether those credentials are used with Our Service or with a Third-Party Service. Sharing or transferring accounts is not permitted.
You agree not to disclose Your password to any third party and must notify Us immediately if You become aware of any unauthorized use of Your account or any other security breach.
You may not use a username that (i) is the name of another person or entity without proper authorization, (ii) infringes the rights of any third party, or (iii) is offensive, vulgar, or otherwise inappropriate.
Your use of the Service, including the Website and API, must at all times comply with applicable laws and regulations, including but not limited to copyright, trademark, export control, and data protection laws. You are solely responsible for ensuring that Your use of the Service is lawful in Your jurisdiction.

The Company reserves the right to suspend or terminate accounts that engage in misuse, abuse, or activity reasonably deemed harmful to the Service, other users, or third parties.
The Company will use commercially reasonable efforts to keep the Service available and operational. However, continuous availability is not guaranteed. The Service may be temporarily unavailable due to maintenance, updates, or technical issues, including urgent or emergency maintenance.
The Company may suspend or limit access to the Service when performing maintenance, adjustments, or improvements, without prior notice where necessary.
The Company shall not be liable for any loss or damage resulting from temporary or partial unavailability of the Service.
The Service and all original content, features, and functionality (excluding content provided by You or other users) are and will remain the exclusive property of the Company and its licensors. Your use of the Service does not grant You any rights to the intellectual property of the Company or its licensors, except for the limited rights necessary to use the Service in accordance with these Terms.
The Service is protected by copyright, trademark, and other intellectual property laws in the Netherlands and internationally.
The Company's trademarks, logos, and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
By submitting Feedback, You agree that the Company may use, modify, and incorporate such Feedback into its products and services without any obligation to compensate You. Feedback will be considered non-confidential and non-proprietary.
By using the Service, You acknowledge and agree that We may send You communications, including emails, relating to your Account, the Service, or your use of the Service. These communications are considered part of the Service and You may not be able to opt out of receiving them while maintaining an active Account.
By using the Service you hereby grant the Company, the Service, and the Website a non-exclusive, worldwide, royalty-free, transferable license to use and display your company's name, logo, trademarks, and trade names (“Company Marks”) solely for the purpose of identifying you as a customer or user of the Service. Such use may include, without limitation, display on the Website and in marketing, promotional, and communication materials intended to showcase the Company's clients and promote the Service. This provision applies only to You as a user of the HttpStatus API under a paid subscription.
If you prefer not to have your Company Marks used for such purposes, you may opt out at any time by providing written notice to support@httpstatus.io. Upon receipt of such notice, the Company will use commercially reasonable efforts to remove your Company Marks from all applicable materials within a reasonable timeframe.
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, terms, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be liable, directly or indirectly, for any damage or loss arising from or related to the use of, or reliance on, any such content, goods, or services available through third-party websites or services. We recommend that You review the terms and privacy policies of any third-party websites You visit.
The Company may suspend or terminate Your Account and access to the Service, at its sole discretion, including (without limitation) if You breach these Terms or engage in conduct that the Company deems harmful to the Service, other users, or the Company.
Upon termination, Your right to use the Service will cease immediately. Any fees already paid are non-refundable, except as required by law.
If You wish to terminate Your Account, You may do so at any time by discontinuing use of the Service and, where applicable, cancelling any active Subscription through the designated account management options.
To the maximum extent permitted by applicable law, the Company and its affiliates, directors, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, goodwill, data, use, business interruption, or the cost of substitute services, arising out of or in connection with Your use of, or inability to use, the Service, regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if the Company has been advised of the possibility of such damages.
The total liability of the Company and its suppliers for any claim arising out of or relating to these Terms or the Service shall not exceed the lesser of (i) the total amount actually paid by You for the Service during the twelve (12) months immediately preceding the event giving rise to the claim, or (ii) €500. If You have not made any payments, the Company's liability shall be limited to €100.
Nothing in these Terms shall exclude or limit liability for gross negligence, willful misconduct, death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither the Company nor any of the company's provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to (i) Your use of the Service in violation of these Terms, (ii) any content or data submitted or transmitted through Your account, or (iii) Your violation of any applicable law or the rights of a third party.
The Company shall not be liable or responsible for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including, without limitation, labor disputes, pandemics, epidemics, civil commotion, war, armed conflict, terrorism, governmental regulations or actions, natural disasters, fire or other casualty, extreme weather, network or infrastructure failures, or other events of force majeure.
The Service may rely on third-party services, including but not limited to Nadles (for API gateway and usage tracking) and Paddle (for billing and payment processing). The Company does not control and is not responsible for the performance, availability, security, or errors of such third-party services. You agree that the Company shall not be liable for any loss or damage arising from or relating to the use of these services.
Your use of such third-party services may also be subject to their own terms of service and privacy policies, and You agree to review and comply with those where applicable, including but not limited to the Nadles Privacy Policy and the Paddle Privacy Policy .
These Terms and Your use of the Service shall be governed by the laws of the Netherlands, without regard to its conflict of law rules. Your use of the Service may also be subject to other applicable local, state, national, or international laws.
If You have any concern or dispute regarding the Service, You agree to first attempt to resolve the matter directly with the Company by contacting support@httpstatus.io. This informal process does not prevent either party from seeking any remedies available under applicable law if the dispute cannot be resolved.
If You are a consumer in the European Union, nothing in these Terms shall limit or exclude any mandatory rights provided by the law of Your country of residence.
If You are a U.S. federal government end user, our Service is a "Commercial Item" as that term is defined at 48 C.F.R. §2.101.
You represent and warrant that You are not located in, or a citizen of, any country subject to a United States government embargo, sanctions, or that has been designated as a "terrorist supporting" country, and that You are not listed on any U.S. government list of prohibited or restricted parties.
You represent and warrant that You will comply with all applicable export and sanctions laws, including but not limited to the laws and regulations of the United States, European Union, United Nations, and any other relevant jurisdiction. You agree not to access or use the Service in any manner that would violate such laws or regulations.
If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified to achieve its intended purpose to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.
Failure to exercise or enforce any right or obligation under these Terms shall not constitute a waiver of such right or obligation, nor shall it prevent its enforcement at a later time.
These Terms may be provided in a language other than English. In the event of any conflict or inconsistency between a translation and the English version, the English version shall prevail.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, you must stop using the Service.
These Terms constitute the entire agreement between You and the Company regarding the Service and supersede all prior and contemporaneous agreements, understandings, communications, and proposals, whether oral or written, relating to the Service.
Nothing in these Terms shall be construed as creating any partnership, joint venture, agency, employment, or fiduciary relationship between You and the Company. You and the Company are independent parties and neither shall have the authority to bind the other in any way.
